This introduction to the special issue on data and agency argues that datafication should not only be understood as the process of collecting and analysing data about Internet users, but also as feeding such data back to users, enabling them to orient themselves in the world. It is important that debates about data power recognise that data is also generated, collected and analysed by alternative actors, enhancing rather than undermining the agency of the public. Developing this argument, we first make (...) clear why and how the question of agency should be central to our engagement with data. Subsequently, we discuss how this question has been operationalized in the five contributions to this special issue, which empirically open up the study of alternative forms of datafication. Building on these contributions, we conclude that as data acquire new power, it is vital to explore the space for citizen agency in relation to data structures and to examine the practices of data work, as well as the people involved in these practices. The topic of annotating legal data has received surprisingly little attention. A key challenge of the annotation process is reaching a sufficient agreement between annotators and filtering mistakes from genuine disagreement. This study presents an approach that provides insights into and resolves potential disagreement amongst annotators. It (1) introduces different strategies to calculate agreement levels and compares (2) agreement levels between annotators (inter-annotator agreement) before and after a revision round and (3) agreement levels for annotators who annotate the same texts (...) twice (intra-annotator agreement). The inter-annotator agreement levels are compared to a revision round in which an arbiter corrected the annotator’s labels. The analysis is based on the annotation of EU legislative provisions at two stages (initial annotations, after annotator revisions) and for various tasks (Definitions, References, Quantities, IF-THEN statements, Exceptions, Scope, Hierarchy, Deontic Clauses, Active and Passive Role) by multiple annotators. The results reveal that agreement levels vary based on the stage of measurement (before/after revisions), the nature of the task, the method of assessment, and the annotator combination. The agreement scores - along with some initial measurements—align with those reported in previous research but increase after each revision round. This suggests that annotator revisions can substantially reduce disagreement. Additionally, disagreements were found not only between but also among annotators. This inconsistency does not appear to stem from a lack of understanding of the guidelines or a lack of seriousness in task execution, as evidenced by moderate to substantial inter-annotator agreement scores. These findings suggest that annotators identified multiple valid interpretations, which highlights the complexity of annotating legislative provisions. The results underscore the significance of embracing, addressing, and reporting about (dis)agreement in different ways and at the various stages of an annotation task. (shrink)

ArgumentSociologists and historians of science, such as Richard Whitley and Stephen Hilgartner, identified a culturally dominant discourse of science popularization in the broader society. In this dominant view, a clear distinction is maintained between scientific knowledge and popularized knowledge. Popularization of science is seen as the process of transmitting real science to a lay public. This discourse on science popularization was criticized by Whitley and Hilgartner as an inadequate simplification. Yet, the battered traditional model of popularization remains remarkably resistant to (...) these theoretical attacks. In this paper I will argue, based on research of the output of the Belgian economist Gustave de Molinari, and more specifically, his opinion on the role of government in economic life, that the boundary between science and popularization in political economy is not clear and that the status of scientists fluctuates over time and in different contexts. It is therefore impossible for historians or economists to distinguish science from popularization based on the essential characteristics or intrinsic quality of the work. De Molinari's ideas are followed through the different media of science and journalism. Although de Molinari himself differentiated between his scientific and “popular” work, the boundary between science and popularization proves to be highly permeable, in both directions. (shrink)

This article investigates the claims and complexities involved in the platform-based economics of health and fitness apps. We examine a double-edged logic inscribed in these platforms, promising to offer personal solutions to medical problems while also contributing to the public good. On the one hand, online platforms serve as personalized data-driven services to their customers. On the other hand, they allegedly serve public interests, such as medical research or health education. In doing so, many apps employ a diffuse discourse, hinging (...) on terms like “sharing,” “open,” and “reuse” when they talk about data extraction and distribution. The analytical approach we adopt in this article is situated at the nexus of science and technology studies, political economy, and the sociology of health and illness. The analysis concentrates on two aspects: datafication and commodification. We apply these analytical categories to three specific platforms: 23andMe, PatientsLikeMe, and Parkinson mPower. The last section will connect these individual examples to the wider implications of health apps’ data flows, governance policies, and business models. Regulatory bodies commonly focus on the safety and security of apps, but pay scarce attention to health apps’ techno-economic governance. Who owns user-generated health data and who gets to benefit? We argue that it is important to reflect on the societal implications of health data markets. Governments have the duty to provide conceptual clarity in the grand narrative of transforming health care and health research. (shrink)

Background The European Union aims to optimize patient protection and efficiency of health-care research by harmonizing procedures across Member States. Nonetheless, further improvements are required to increase multicenter research efficiency. We investigated IRB procedures in a large prospective European multicenter study on traumatic brain injury, aiming to inform and stimulate initiatives to improve efficiency. Methods We reviewed relevant documents regarding IRB submission and IRB approval from European neurotrauma centers participating in the Collaborative European NeuroTrauma Effectiveness Research in Traumatic Brain Injury. (...) Documents included detailed information on IRB procedures and the duration from IRB submission until approval. They were translated and analyzed to determine the level of harmonization of IRB procedures within Europe. Results From 18 countries, 66 centers provided the requested documents. The primary IRB review was conducted centrally or locally and primary IRB approval was obtained after one, two or three review rounds with a median duration of respectively 50 and 98 days until primary IRB approval. Additional IRB approval was required in 55% of countries and could increase duration to 535 days. Total duration from submission until required IRB approval was obtained was 114 days and appeared to be shorter after submission to local IRBs compared to central IRBs. Conclusion We found variation in IRB procedures between and within European countries. There were differences in submission and approval requirements, number of review rounds and total duration. Research collaborations could benefit from the implementation of more uniform legislation and regulation while acknowledging local cultural habits and moral values between countries. (shrink)

An important challenge when creating automatically processable laws concerns open-textured terms. The ability to measure open-texture can assist in determining the feasibility of encoding regulation and where additional legal information is required to properly assess a legal issue or dispute. In this article, we propose a novel conceptualisation of open-texture with the aim of determining the extent of open-textured terms in legal documents. We conceptualise open-texture as a lever whose state is impacted by three types of forces: internal forces (the (...) words within the text themselves), external forces (the resources brought to challenge the definition of words), and lateral forces (the merit of such challenges). We tested part of this conceptualisation with 26 participants by investigating agreement in paired annotators. Five key findings emerged. First, agreement on which words are open-texture within a legal text is possible and statistically significant. Second, agreement is even high at an average inter-rater reliability of 0.7 (Cohen’s kappa). Third, when there is agreement on the words, agreement on the Open-Texture Value is high. Fourth, there is a dependence between the Open-Texture Value and reasons invoked behind open-texture. Fifth, involving only four annotators can yield similar results compared to involving twenty more when it comes to only flagging clauses containing open-texture. We conclude the article by discussing limitations of our experiment and which remaining questions in real life cases are still outstanding. (shrink)

Identifying genomic homology within and between genomes is essential when studying genome evolution. In the past years, different computational techniques have been developed to detect homology even when the actual similarity between homologous segments is low. Depending on the strategy used, these methods search for pairs of chromosomal segments between which either both gene content and order are conserved or gene content only. However, due to fact that, after their divergence, homologous segments can lose a different set of genes, these (...) methods still often fail to detect genomic homology. In this paper we give a differential lifting principle which provides a general method to geometrically axiomatize the model companion (if it exists) of some theories of differential topological fields. The topological fields we consider here are in fact topological systems in the sense of van den Dries, and the lifting principle we develop is a generalization of the geometric axiomatization of the theory DCF₀ given by Pierce and Pillay. Moreover, it provides a geometric alternative to the axiomatizations obtained by (...) Tressl and Guzy/Point in separate papers where the authors also build general schemes of axioms for some model complete theories of differential fields. We first characterize the existentially closed models of a given theory of differential topological fields and then, under an additional hypothesis of largeness, we show how to modify this characterization to get a general scheme of first-order axioms for the model companion of any large theory of differential topological fields. We conclude with an application of this lifting principle proving that, in existentially closed models of a large theory of differential topological fields, the jet-spaces are dense in their ambient topological space. The book was conceived and designed by Jan Fabre, author, theatre artist, and visual artist, active since the 1970s. The book was written by Luk Van den Dries, dramaturg and theatre researcher of the University of Antwerp, in tight collaboration with Jan Fabre (...) and the three most important performers/teachers of the Belgian theatre company, Troubleyn (Annabelle Chambon, Cédric Charron, and Ivana Jozic). The book sheds new light on the physical, mental, and vocal training of the performer and furthermore gives insight into Fabre's revolutionary thoughts on contemporary theatre.1Breathing is the first of the ten performative principles that together create the basic grammar in which the language of the performers is grounded.Three-phased breathing (one part in, one part out, one part nothing) is a basic condition in the series of exercises Jan Fabre developed throughout his career. This respiration technique returns in all exercises. In 2011, van Dijck and Fias described a positional SNARC effect: the SPoARC. To-be-remembered items presented centrally on a screen seemed to acquire a left-to-right spatial dimension. If confirmed, this spatialization could be crucial for immediate memory theories. However, given the intricate links between visual and spatial dimensions, this effect could be due to the visual presentation, which could have probed the left-to-right direction of reading/writing. To allow a generalization of this effect, we adapted van Dijck and Fias's (...) task using an auditory version of Sternberg's paradigm. Lists of five consonants were auditorily presented at a rate of 3 s/item. A SPoARC effect was observed. The consequences are discussed first from an immediate memory perspective, putting forward the view that order could be coded through spatialization, and then in terms of similarities between SPoARC and SNARC. ABSTRACT:This paper argues that, although stakeholder engagement occurs within the context of power, neither market-centered CSR nor the deliberative model of political CSR adequately addresses the specter of power asymmetries and the inevitability of conflict in stakeholder relations, particularly for powerless stakeholders. Noting that the objective of stakeholder engagement should not be benevolence toward stakeholders, but mechanisms that address power asymmetries such that stakeholders are able to protect their own interests, I present a framework of stakeholder engagement based on agonistic (...) pluralism that seeks to structure and utilize discord rather than reduce or eliminate it. I then propose arbitration as an agonistic mechanism to address power asymmetries in stakeholder engagement and explore its implications. (shrink)

The role intellectual virtues play in scientific inquiry has raised significant discussions in the recent literature. A number of authors have recently explored the link between virtue epistemology and philosophy of science with the aim to show whether epistemic virtues can contribute to the resolution of the problem of theory choice. This paper analyses how intellectual virtues can be beneficial for successful resolution of theory choice. We explore the role of virtues as well as vices in scientific inquiry and their (...) beneficial effects in the context of theory choice. We argue that vices can play a role in widening the set of potential candidate theories and support our claim with historical examples and normative arguments from formal social epistemology. We argue that even though virtues appear to be neither necessary nor sufficient for scientific success, they have a positive effect because they accelerate successful convergence amongst scientists in theory choice situations. Most syntacticians, no matter their theoretical persuasion, agree that features are the most important units of analysis. Within Chomskyan generative grammar, the importance of features has grown steadily and within minimalism, it can be said that everything depends on features. They are obstacles in any interdisciplinary investigation concerning the nature of language and it is hard to imagine a syntactic description that does not explore them. For the first time, this book turns grammar upside down and proposes a new model (...) of syntax that is better suited for interdisciplinary interactions, and shows how syntax can proceed free of lexical influence. The empirical domain examined is vast, and all the fundamental units and properties of syntax are rethought. Although stakeholder theory is concerned with stakeholder engagement, substantive operational barometers of engagement are lacking in the literature. This theoretical paper attempts to strengthen the accountability aspect of normative stakeholder theory with a more robust notion of stakeholder engagement derived from the concept of good faith. Specifically, it draws from the labor relations field to argue that altered power dynamics are essential underpinnings of a viable stakeholder engagement mechanism. After describing the tenets of substantive engagement, the paper draws from the (...) labor relations and commercial law literatures to describe the characteristics of good faith as dialogue, negotiation, transparency, and totality of conduct; explains how they can be adapted and applied to the stakeholder context; and suggests the use of mediation and non-binding arbitration. The paper concludes by addressing anticipated objections and shortcomings and discussing implications for theory and research. (shrink)

This article argues that the concept of deliberation is construed too narrowly in political corporate social responsibility (CSR) and that a concept of deliberation for political CSR should err toward useful speech acts rather than reciprocity and charity. It draws from the political philosophy, labor relations, and business ethics literatures to outline a framework for an extended notion of deliberative engagement. The characters of deliberative behavior and deliberative environment are held to generate four modes of engagement: strategic deliberation, unitarist deliberation, (...) pluralist deliberation, and deliberative activism. The article concludes by arguing that political CSR will be better positioned to realize its potential by moving away from primarily consensus-centered objectives to a more responsive range of deliberative goals and practice. Defined and formalized several decades ago, widely used in philosophy and game theory, the concept of common knowledge is still considered as problematic, although not always for the right reasons. I suggest that the epistemic status of a group of human agents in a state of common knowledge has not been thoroughly analyzed. In particular, every existing account of common knowledge, whether formal or not, is either too strong to fit cognitively limited individuals, or too weak to adequately describe their (...) state. I provide a realistic definition of common knowledge, based on a formalization of David Lewis’ seminal account and show that it is formally equivalent to probabilistic common belief. This leads to a philosophical analysis of common knowledge which answers several common criticisms and sheds light on its nature. (shrink)

This paper introduces Agreement Theorems to dynamic-epistemic logic. We show first that common belief of posteriors is sufficient for agreement in epistemic-plausibility models, under common and well-founded priors. We do not restrict ourselves to the finite case, showing that in countable structures the results hold if and only if the underlying plausibility ordering is well-founded. We then show that neither well-foundedness nor common priors are expressible in the language commonly used to describe and reason about epistemic-plausibility models. The static agreement (...) result is, however, finitely derivable in an extended modal logic. We provide the full derivation. We finally consider dynamic agreement results. We show they have a counterpart in epistemic-plausibility models, and provide a new form of agreements via public announcements. (shrink)

Most definitions of cooperation provide sufficient but not necessary conditions. This paper describes a form of minimal cooperation, corresponding to mass actions implying many agents, such as demonstrations. It characterizes its intentional, epistemic, strategic, and teleological aspects, mostly obtained from weakening classical concepts. The rationality of minimal cooperation turns out to be part of its definition, whereas it is usually considered as an optional though desirable feature. Game-theoretic concepts thus play an important role in its definition. The paper concludes by (...) answering concrete questions about what should and should not be called cooperation. (shrink)

Ordinary common knowledge is formally expressed by strong probabilistic common belief. How strong exactly? The question can be answered by drawing from the similar equivalence, recently explored, between plain and probabilistic individual beliefs. I argue that such a move entails that common knowledge displays a double fragility: as a description of a collective state and as a phenomenon, because it can respectively disappear as group size increases, or more worryingly as the epistemic context changes. I argue that despite this latter (...) fragility, the effects of common knowledge on action are robust. Unfortunately, this in turn leads to a third fragility, that of the concept of common knowledge, which threatens to collapse on probabilistic common belief. This also reveals a disanalogy between the individual and the collective cases. I finally pinpoint the subtle difference entailed by the two concepts, expressed in terms of the attitude towards contrary evidence or of the agents’ awareness. As a result, common knowledge can be defended as a concept, which refers to a fragile yet distinct collective attitude. (shrink)

Recent years have witnessed an increased number of game-theoretic approaches to social norms, which apparently share some common vocabulary and methods. We describe three major approaches of this kind (due to Binmore, Bicchieri and Gintis), before comparing them systematically on five crucial themes: generality of the solution, preference transformation, punishment, epistemic conditions and type of explanation. This allows us to show that these theories are, by and large, less compatible than they seem. We then argue that those three theories struggle (...) to account for three phenomena pertaining to social norms (namely context-dependence, conflicting norms and self-evidence), with which any complete game-theoretic account should in principle be able to deal. Racial injustice in employment demands the attention of business organizations because it profoundly shapes our life prospects. While comparing the ideal of perfectly equal opportunity with its invariably imperfect alternatives can impede reform, the true challenge lies in addressing persistent inequities as we strive for equality. This article introduces “shared inequity” as a frame of reference for assessing workplace racial disparities and emphasizing a collective responsibility to remedy systemic issues. In critiquing an exaggerated notion of meritocracy, I emphasize that structural (...) racism, rather than just individual acts, facilitates collective advantages, especially for White males. Hence, it is morally fitting to frame racial justice in employment, not only in terms of perfect equality, but also in terms of justly sharing an imbalance that cannot be corrected without counterbalance. The “shared inequity” lens offers a more realistic and just approach to pursuing racial justice in the workplace. (shrink)
